On May 10, the Justice Department charged two Chinese nationals with providing guidance on procuring flight-training devices that mimic satellite and aircraft tracking systems to support unlawful interference with satellite navigation services.
According to the Department of Justice:
“Tracking devices generate electronic signals that communicate with other devices and are used by many different electronic technologies, including the Global Positioning System (GPS), Global Navigation Satellite System (GLONASS), and Russian Global Navigation Satellite System (GLONASS). Commercial cell phone companies use GPS and GLONASS signals to provide customers with location information on their cell phones.”
“The defendants were charged by criminal complaint,” said Assistant Attorney General Demers. “One of the defendants was the owner of an aviation-training company in the United States. He allegedly used the company to provide guidance to Chinese nationals about the physical appearance and operation of devices used to communicate with the GPS and GLONASS satellite navigation systems. The other defendant, charged under a criminal information, was the person who received the training and provided that guidance. We have made clear that the United States will hold accountable those who conduct or support cyber-enabled theft and endangerment of important U.S. government systems and property.”
The defendants are charged with conspiracy to commit wire fraud and each faces a maximum sentence of five years in prison. A federal indictment is not necessary to commence criminal proceedings.
As alleged in the charges, the defendants knowingly made false statements and claims about the capabilities of the device they sold as providing intrusion resistance. The defendants knew that the device did not physically or functionally provide such resistance.
