This case, brought pursuant to 28 U.S.C. § 1581(a), is before the court on Defendant’s motion to dismiss for lack of subject matter jurisdiction. On May 5, 2003, Bold Group, Inc. (“Plaintiff) entered into a Service Contract, Contract No. DA0-46-C-0037, with the General Services Administration (“GSA”) for the operation of a Federal Supply Service Center in Jacksonville, Florida. On May 5, 2003, Plaintiff submitted an “Agreement for Government Furnished Property” (“GFP”), No. DA0-46-C-0241, *1363 to GSA in Jacksonville, Florida, in order to obtain a federal building. Included in this GFP was a “Building Access Agreement” that GSA eventually signed with Plaintiff. Pursuant to this GFP agreement, Plaintiff agreed to “[s]ubmit to [GSA] any notice, complaint, claim or appeal under the Contract or under any regulation of the [General Services Administration] which are [sic] related to the operations of the site.” In re Bold Group, Inc., No. 05-00407, 2005 WL 1641770 (Oct. 5, 2005), Memorandum Opinion and Order at 10.
On March 7, 2005, the GSA sent Plaintiff a notice of violation and a final contracting officer’s decision, asserting that the Building Access Agreement signed by Plaintiff was materially defective because it failed to satisfy the requirements set forth at

1. Damping factor:
The damping factor controls the amount of energy lost within the cabinet. It is placed in octaves from 0.01 to 10, which is equivalent to a Q factor of 100.0. An octave is equal to one tenth of the range of the 0–10 decibel scale.
2. Frequency:
The frequency set controls the frequency response of the loudspeaker cabinet, by shifting the response left or right on the 0–10 decibel scale. The frequency is given in hertz, and since its octave equivalent is 1/10 of a decade, its equivalent would be 10^(frequency in hertz). The most extreme value of the frequency would be 10^(frequeny in hertz), or 10^(10^(frequency in hertz)).
3. Volume:
The volume set controls the volume of the loudspeaker cabinet. This is applied by a dB range from -10 dB to +10 dB. The most extreme value of the volume would be -10 dB, or -10^(decibel range).

The research project is focused on the development of a complete simulation and analysis system for analog signal processing electronic equipment. The preamplifier section of the system can be used as a stand-alone signal processing tool and the use of this system is exemplarily demonstrated by mathematical and numerical simulation and visualization of a circuit analyzer (ACPA, Analog Circuit Phasors Analyser) based on a compact 12-bit microcontroller. An innovative feature of the research project is the three-dimensional loudspeaker cabinet simulator section that allows for a wide variety of loudspeaker cabinet shapes and acoustics.
In the following sections, the research project is presented from the perspective of science, mathematics and electronics. More scientific and mathematical aspects of the research are presented in the relevant section of the technical report. Furthermore, a description of the architecture of the research system is provided and a high level view of the software application framework of the ACPA simulation system. A technical overview of the preamplifier sub-system is provided in more detail in the chapter devoted to the ACPA simulator.
