ORDER DENYING DEFENDANT’S MOTION TO DISMISS

This cause came on to be heard upon Motion of the defendant to dismiss the complaint, and the court having examined the motion and heard argument of counsel, it is considered and adjudged that the motion is meritorious and should be and is hereby denied, and the court having entered orders in conformity with this decision.
FINDINGS OF FACT
1. On March 19, 1981 the plaintiff filed his complaint seeking a determination of dischargeability.
2. The complaint alleges that the defendant operated as a sole proprietorship doing business as Bouchard Trucking and on or about November 28, 1978 the defendant transferred $120.55 to the defendant for the purpose of promoting and carrying on the operations of the sole proprietorship. The complaint further alleges that defendant filed his petition under Chapter 7 on February 12, 1981.
3. The defendant filed his answer to the complaint and in addition to denying the material allegations of the complaint he also alleges that the court does not have jurisdiction to determine dischargeability.
ISSUE
Is the bankruptcy court competent under 11 U.S.C. § 523(a)(2)(A) to determine whether a debt is dischargeable because of false pretenses or false representation?
DECISION
The court concludes that it has jurisdiction to determine dischargeability under § 523(a)(2)(A).
